These Terms of Use (“Terms”) govern access to and use of paradisecitydesign.com and related pages and features operated by Paradise City Inc., doing business as Paradise City Design (“Paradise City Design,” “we,” “us,” or “our”), collectively referred to as the “Site.” By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Informational Purpose

The Site provides general information about Paradise City Design, its portfolio, interior design services, design process, and related topics. Site content is not architectural, engineering, legal, financial, safety, building-code, permitting, or other professional advice. Information on the Site does not replace a project-specific evaluation or written agreement.

2. No Client Relationship or Guarantee

Viewing the Site, submitting a form, requesting a consultation, or exchanging preliminary communications does not create a designer-client, contractor-client, fiduciary, or other professional relationship. A client relationship begins only when the appropriate parties sign a separate written agreement.

Portfolio images and descriptions illustrate prior work and design concepts. Results vary based on the property, scope, budget, schedule, approvals, availability, vendors, contractors, and other circumstances. We do not guarantee identical results, availability, project acceptance, pricing, timing, permits, approvals, or third-party performance.

3. Project Services and Independent Professionals

Any interior design, design documentation, selections, visualization, procurement assistance, construction coordination, or other project services are governed by a separate written agreement.

Contractors, architects, engineers, installers, fabricators, vendors, and other licensed or independent professionals are responsible for their own work, contracts, pricing, schedules, permits, licenses, insurance, code compliance, warranties, and legal obligations. Nothing on the Site represents that Paradise City Design performs services requiring a professional or contractor license unless expressly stated in a separate applicable agreement.

4. Permitted Use

You may use the Site only for lawful, personal, and legitimate business purposes. You may not:

• Use the Site in violation of law or the rights of another person.
• Attempt to gain unauthorized access to the Site, accounts, servers, or systems.
• Interfere with Site security, operation, forms, analytics, or availability.
• Transmit malware, automated spam, deceptive inquiries, or harmful code.
• Scrape, harvest, copy, republish, or commercially exploit Site content except as expressly permitted by law or written authorization.
• Misrepresent your identity, affiliation, authority, or purpose.

5. Intellectual Property

The Site and its original content, including text, photographs, renderings, layouts, graphics, logos, branding, videos, and design elements, are owned by or licensed to Paradise City Design and are protected by intellectual-property laws. No ownership rights are transferred to you.

You may view the Site for personal, noncommercial informational purposes. Any other reproduction, modification, distribution, display, publication, or commercial use requires prior written permission from the applicable rights holder.

6. Materials You Submit

You represent that you have the right to submit any message, photograph, plan, drawing, document, or other material you provide through the Site. You grant Paradise City Design a limited right to receive, copy, store, review, and use submitted materials only as reasonably necessary to respond to your inquiry, evaluate requested services, maintain records, and protect legal and security interests.

Submitting material does not authorize public use, portfolio publication, advertising use, or transfer of ownership unless separately agreed in writing.

7. Third-Party Links and Services

The Site may link to or use services operated by third parties. We do not control and do not endorse or guarantee third-party content, availability, privacy, security, products, services, pricing, or performance. Your use of a third-party service is governed by that provider’s terms and policies.

8. Website Availability and Accuracy

We make reasonable efforts to maintain accurate and useful information, but the Site is provided on an “as is” and “as available” basis. Content may contain errors or become outdated. We may modify, suspend, or discontinue any Site feature or content without notice.

9. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, Paradise City Design disclaims warranties regarding the Site, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

To the fullest extent permitted by law, Paradise City Design and its officers, employees, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of, inability to use, or reliance on the Site. These limitations do not exclude liability that cannot lawfully be excluded.

Our Privacy Policy explains how information is collected, used, and shared through the Site and is incorporated into these Terms by reference.

11. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to applicable law, disputes relating to the Site or these Terms will be brought in the state or federal courts located in Miami-Dade County, Florida.

12. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on this page with an updated effective date. Changes apply prospectively from the date posted.

13. Severability and No Waiver

If a provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law. A failure to enforce a provision is not a waiver of that provision or any other right.
